อำนาจละมุนของกฎหมาย: การเมืองเชิงวัฒนธรรมในกฎหมาย

บทคัดย่อ
กฎหมายมิได้มีเพียงอำนาจที่แข็งกร้าวในลักษณะของการข่มขู่ด้วยโทษและชักนำด้วยผลประโยชน์เท่านั้น แต่ยังประกอบไปด้วยอำนาจละมุนของกฎหมาย ที่เป็นพลังดึงดูดให้เกิดการปฏิบัติตามกฎหมายด้วยขุมกำลังของอำนาจละมุนทางกฎหมายประกอบไปด้วยวัฒนธรรมทางกฎหมาย ระบบคุณค่าทางกฎหมาย และการกำหนดนโยบายทางกฎหมาย ทั้งนี้ ขบวนการศึกษากฎหมายกับมนุษยศาสตร์ได้วางรากฐานอย่างสำคัญในการริเริ่มศึกษากฎหมายด้วยความรู้สึก โดยในยุคข้อมูลข่าวสาร อำนาจละมุนทางกฎหมายยิ่งทวีความสำคัญมากขึ้นในฐานะที่เป็นเครื่องมือในการต่อสู้และต่อรองทางวัฒนธรรมกฎหมาย ในอดีตประเทศไทยเคยดำเนินนโยบายวัฒนธรรมทางเนติธรรมในช่วงสมัยการปกครองของคณะราษฎร แต่ถูกลดความสำคัญลงไปหลังทศวรรษ 2490 นอกจากนี้ อำนาจละมุนทางกฎหมายยังมีลักษณะเป็นพลวัตที่มีปฏิสัมพันธ์กับสังคมการเมืองอยู่ตลอดเวลา
