สหภาพยุโรปได้กำหนดข้อบังคับสหภาพยุโรปฉบับที่ 2009/125/EC ในวันที่ 21 ตุลาคม 2009 ว่าด้วยหลักเกณฑ์การออกแบบเชิงนิเวศเศรษฐกิจสำหรับผลิตภัณฑ์ที่เกี่ยวข้องกับพลังงาน ข้อบังคับดังกล่าวมีวัตถุประสงค์ที่จะลดผลกระทบด้านสิ่งแวดล้อมจากผลิตภัณฑ์ที่เป็นแหล่งกำเนิดแสงสว่างประเภทต่างๆ รวมไปถึงการบริโภคพลังงานและการควบคุมมลภาวะทางแสงผ่านการออกแบบเชิงนิเวศเศรษฐกิจ อย่างไรก็ตาม ข้อบังคับดังกล่าวไม่ได้กำหนดหลักการออกแบบเชิงนิเวศสำหรับแก้ปัญหาและผลกระทบจากมลภาวะทางแสงในทุกกรณีอันเนื่องมาจากการใช้แสงสว่างในระดับความส่องสว่างที่เกิดไปกว่ามาตรฐานความต้องการในการใช้งานทั่วไปและทิศทางการส่องของแสงที่ไม่เป็นมิตรต่อสิ่งแวดล้อม ดังนั้น กฎหมายสหภาพยุโรปในอนาคตจึงควรมีมาตรฐานการออกแบบเชิงนิเวศเศรษฐกิจเพื่อขจัดปัญหามลภาวะทางแสงในทุกกรณี ซึ่งแม้ว่าการออกแบบเชิงนิเวศเศรษฐกิจจะส่งผลดีต่อสิ่งแวดล้อมและระบบนิเวศก็ตาม แต่การสหภาพยุโรปและประเทศสมาชิกก็ควรจะเพิ่มมาตรการการออกแบบเชิงนิเวศอื่นๆ ในการป้องกันการใช้งานแสงสว่างไม่ให้ก่อให้เกิดปัญหามลภาวะทางแสงได้
Abstract
The European Union (EU) adopted the Directive 2009/125/EC of 21 October 2009 establishing a framework for the setting of ecodesign requirements for energy-related products (ErP Directive). This EU framework purposes to reduce the environmental impact of lighting products, including the energy consumption and light pollution control throughout their Ecodesign approaches and practices. However, the ErP directive does not include ecodesign requirements for all aspects of light pollution from excessive levels of illumination or non-environmentally friendly direction of lighting. So, the focus of the future EU Ecodesign provisions should be on all aspects of light pollution impacts. There are many good reasons to ecologically use and design lighting on property, but the EU and its Member States should take ecodesign steps to prevent use of lights from becoming light pollution.
