บทคัดย่อ

            บทความชิ้นนี้มุ่งหมายที่จะอธิบายถึงกฎหมายที่เกี่ยวข้องกับการชุมนุมสาธารณะและการประท้วงในสาธารณรัฐฝรั่งเศส ในภาพรวม ระบอบของเสรีภาพในการชุมนุมสาธารณะของฝรั่งเศสวิวัฒนาการไปในแนวทางที่เอื้อต่อเสรีภาพของประชาชนเป็นลำดับ ทั้งนี้ ภายใต้เงื่อนไขความจำเป็นในการหาสมดุลระหว่างการรับรองเสรีภาพขั้นพื้นฐานในการแสดงออกและการมีส่วนร่วมทางการเมืองของประชาชนในระบอบเสรีประชาธิปไตยและการรักษาความสงบเรียบร้อยและความปลอดภัยสาธารณะ ซึ่งศาลปกครองของฝรั่งเศสมีบทบาทสำคัญในการหาสมดุลเช่นว่านั้นผ่านการตรวจสอบความชอบด้วยกฎหมายของการบังคับใช้หลักเกณฑ์เกี่ยวกับเสรีภาพของเจ้าหน้าที่ของรัฐ

This article aims to describe the regime of freedom of assembly and demonstration in France. Overall, the regime has gradually evolved to be more protective of such freedom. The imperative is to find balance between protecting fundamental freedom of expression and public participation in decision-making, on one hand, and safeguarding public order and public safety, on the other. French administrative courts play an important role in finding such balance via legality control of application of provisions on freedom of assembly.
