PROBLEMS OF PROVINCIAL OFFICE OF THE NATIONAL ANTI-CORRUPTION COMMISSION OFFICERS’ PERFORMANCE IN COLLECTING EVIDENCES ON CORRUPTION IN SUB-DISTRICT ADMINISTRATION ORGANIZATION

Abstract

This is qualitative research purposing 1) To analyst the legal regulations, rules problems relating to prevent and suppress the corruption of state officers who have been accused, 2) To analyst the problems of provincial ONACC officers’ performance that affects the investigation, inspection, and gathering evidence of state officers. This study area are 4 provinces. The methodology consisted of document research, in-depth interview, and brainstorming. According to the study of the inquiry officers’ performance, the workload of accusation and on-progress cases are enormous. The number of local inquiry officers does not relate to the workload, including other prevention works. The officers in the province must help each other. They deprive of knowledge and understanding in the laws, experiences in the operation, the administration supports, update guidelines, problems of collecting evidence, lacking understanding in official documents and content system of inspectors, and delaying of case consideration, coordination between inspection unit or accused officers; these affect the delay of effective and efficient performance.

Regarding the aforementioned, it leads to 4 suggestions to enhance the efficiency. 1) the authorized officers considers the new regulation as a mean to build the common accurate practices about the duration of operation in compliance with the new constitution. 2) the on the job training (OJT) for the inquiry officers lacks experiences by positioning them to assist the seniors, the training of other laws that relate to the practice of inquiry officers in the local areas, the promotion or training of case management, case priority management. 3) analysis of inquiry officer capacity in the local area conforms to the quantity of cases. 4) a last suggestion is the teaching of other state officers to understand about anti-corruption law.
