บทคัดย่อ
รัฐไทยมีบทบัญญัติกฎหมายที่ให้หลักประกันเสรีภาพในการรวมตัวและแสดงออกเพื่อส่งเสริมการมีส่วนร่วมของประชาชนในการเรียกร้องสิทธิในสิ่งแวดล้อมและฐานทรัพยากรทั้งในรัฐธรรมนูญและพันธกรณีสิทธิมนุษยชนระหว่างประเทศที่ไทยเป็นภาคี อย่างไรก็ดีมีกฎหมายลำดับรองหรือมาตรการทางปฏิบัติบางประการสร้างอุปสรรคต่อการรวมกลุ่มในโลกไซเบอร์เพื่อแสดงออกในประเด็นสิ่งแวดล้อมและฐานทรัพยากรจากกรณีศึกษาในไทยและต่างประเทศแสดงให้เห็นถึงแนวทางในการขับเคลื่อนขบวนการเรียกร้องสิทธิด้านสิ่งแวดล้อมที่ใช้การรวมกลุ่มในโลกเสมือนเพื่อขยายพลังในการแสดงออกทางความคิดไปสู่สังคมอันอาจเป็นกลยุทธ์ที่นำมาปรับใช้การสนับสนุนกลุ่มได้แต่ก็ปรากฏกรณีที่รัฐจำกัดสิทธิหรือใช้มาตรการไม่เป็นคุณต่อการใช้เสรีภาพจนกลายเป็นผลร้ายต่อการมีส่วนร่วมของประชาชน บทความวิจัยนี้ค้นพบบทเรียนในการส่งเสริมการมีส่วนร่วมของประชาชนยิ่งไปกว่านั้นการศึกษากฎหมายและมาตรการในต่างประเทศเชิงเปรียบเทียบยังทำให้สามารถเลือกรูปแบบหลักประกันสิทธิและกลไกคุ้มครองสิทธิที่เหมาะสมต่อการนำมาปรับใช้กับรัฐไทย
