เสรีภาพในการเล่นมุกตลก ระบอบอารมณ์ขัน และผู้อยู่ในสถานะรอง: การล้อเลียน ผู้มีความหลากหลายทางเพศและพื้นที่สีเทาของกฎหมาย

บทคัดย่อ
บทความนี้ต้องการฉายให้เห็น “พื้นที่สีเทาของกฎหมาย” เกี่ยวกับการกำกับความตลกขบขันในสังคมไทย โดยการใช้วิธีวิทยาแบบสหวิทยาการอันเป็นการใช้ฐานคิดกฎหมายและมนุษยศาสตร์ เพื่อนำเสนอประเด็นความขัดแย้งระหว่างเสรีภาพในการเล่นมุกตลกซึ่งเป็นส่วนหนึ่งของเสรีภาพในการแสดงออกกับการกำกับการเล่นมุกตลกเพื่อล้อเลียนกลุ่มผู้มีความหลากหลายทางเพศซึ่งเป็นกลุ่มผู้อยู่ในสถานะรองผ่านระบอบอารมณ์ขันในสังคม ทั้งนี้ เพื่อชี้ว่า ในขณะที่ระบอบอารมณ์ขันทำหน้าที่กำกับความตลกขบขันเกี่ยวกับเรื่องดังกล่าว และเปิดพื้นที่ให้เสียงของกลุ่มผู้มีความหลากหลายทางเพศปรากฏขึ้น แต่ก็สะท้อนความล้าหลังของกฎหมายในสภาวะที่อารมณ์ความรู้สึกของคนในสังคมเกี่ยวกับการล้อเลียนผู้มีความหลากหลายทางเพศได้เปลี่ยนแปลงไป เพราะไม่มีกฎหมายบัญญัติไว้เป็นการเฉพาะเพื่อกำกับการแสดงออกดังกล่าว
