Freedom to Joke, Humor Regime, and the Subaltern: Mockery of LGBTQIAN+ and the Legal Gray Zone

Abstract
This article seeks to illuminate the “legal gray zone” surrounding regulations of humor in Thai society by advancing an interdisciplinary methodological framework through the critical lens of the law and humanities paradigm. It exhibits tensions arising from freedom to joke, a component of freedom of expression, and the regulations of joke targeting LGBTQIAN+, also known as the subaltern group, through the humor regime.
The article argues that while the humor regime regulates jokes targeting LGBTQIAN+ and has enabled an emergence of the voice of the voiceless, it also reflects that the law is behind social change in a context where social emotions towards mockery of LGBTQIAN+ have changed, since there are no laws regulating such expressions.
