The Problems of the injured person who is the plaintiff in the juvenile delinquency case

Abstract
The Juvenile and Family Court and Juvenile and Family Case Procedure Act B.E. 2553 (2010) contains provisions to protect the rights of the child or the youth who commit an offence that involves criminal procedure. There are statutory provisions that obstruct the right of an injured person to be a plaintiff in a juvenile delinquency case. The law stipulates the conditions for prosecution of juvenile offenders. A victim cannot initiate a criminal proceeding in the Juvenile and Family Court without a permission from the Director of the Observation Centre or a permission from the Juvenile and Family Court. This is a limitation of the right of an injured person to criminal prosecution, which is the basic right of the injured person that should be protected. The paper examines obstacles and problems related to conditions and limitations in criminal proceedings initiated by the injured person as a plaintiff in a juvenile delinquency case. It identifies solutions that would make law more effective in order to protect both the rights of the child or the youth who commit an offence as well as the rights of the injured person.
