Economic Analysis of Law on the Enforcement of Personal Data Protection Law: A Principal-Agent Theory Perspective

Abstract
This article is an experiment that applies the principal-agent problem concept, an economic theory, to analyze issues in Thai law enforcement. The study uses the Personal Data Protection Act B.E. 2562 (2019) as a case study. The research aims to understand the challenges in enforcing Thailand's data protection law through the lens of the principal-agent problem, with the legislature designated as the principal and other state agencies as agents tasked with implementing the principal's intentions.
The study finds that the principal-agent problems arising from the Act stem from information asymmetry and moral hazard. These issues result in law enforcement aligning with the legislature's (principal) intentions. The authors analyse this problem through two case studies: (1) conflicts between principal and agent in enacting secondary legislation and (2) conflicts between principal and agent in interpreting the law. Studying the law through this principal-agent theory will be helpful for further critique and suggestions for amendment of the law.
