Courts of Justice as Symbolic Spaces of Power: Objects, Space, and State Strategies in Thailand

Abstract

This article interrogates the Thai Courts of Justice as a “juridical field” wherein the state leverages symbolic power to institutionalize legitimacy through legal architecture, material objects, and judicial rituals. Drawing upon Pierre Bourdieu’s sociological framework, the study provides a comparative analysis of the variegated historical and cultural landscapes of Chiang Mai, Nonthaburi, and Pattani. The findings reveal that despite the uniform imposition of a centralized “master plan” for judicial space, the dynamics of power establishment fluctuate according to the “habitus”, the deeply ingrained cognitive and predisposed structures, unique to each locale.

Significant patterns emerge from this spatial interaction: ranging from a state of doxatic acceptance (Doxa) in Nonthaburi and “enforced doxa” under structural regulation in Chiang Mai, to an ontological clash leading to symbolic violence and the manifestation of “lawfare” in Pattani. Furthermore, the article highlights contemporary dynamics wherein the erosion of doxa, precipitated by political awakening and crises of legitimacy, prompts the state to reconfigure the juridical field into a “legal fortress.” This transformation serves to monopolize the official definition of truth and rehabilitate the perceived sanctity of the institution through rigorous criminal punitive measures. The study concludes that deconstructing the court as a site of symbolic power operations is fundamental to a critical re-evaluation of the Rule of Law and the conceptualization of justice in contemporary Thai society.
