Preparedness of mediators according to the dispute mediation Act B.E. 2562

Alternative dispute resolution has become increasingly popular in addressing social conflicts. However, in Thai society, there are still issues with implementing it effectively. Therefore, the objectives of this study are 1) to examine the readiness of mediators according to the DISPUTE MEDIATION ACT, B.E. 2562 (2019) and 2) to investigate appropriate preparation methods for mediators under the Act. This research utilized a mixed-methods approach. For the quantitative research, data was collected from a convenient sample of 200 registered mediators who are responsible for resolving disputes. They were selected from a total of 321 mediators nationwide. For the qualitative research, in-depth interviews were conducted with 5 experienced mediators.
The results of the study indicate that the readiness levels of mediators in terms of knowledge, skills, abilities, and problems related to the DISPUTE MEDIATION ACT, B.E. 2562 (2019) are high. In particular, they possess a high level of legal knowledge related to the Act and high levels of negotiating skills. Furthermore, their desired characteristics are also at a high level, particularly in terms of presentation and prioritization of issues. Preparation for mediators should cover all three areas: knowledge, skills, and abilities.
