Communication of Online Child Protection Laws against Parental Actions

Abstract

This research studies the laws and measures to protect children from the actions of parents by publishing or transmitting information about children online, in case of posting pictures / animations or children's clips; child pornography; and exploitation of children. A document research method is used to collect information from websites, documents, textbooks, articles, research reports, the code law, and various related measures to analyze the content and communicate to society to become more aware of this matter. The results of the study are as follows:

          1) In the case of posting pictures / animations or clips of children, it is a violation of the rights of children certified in the Thai constitution. There is no specific provision applicable but there are broad prohibitions on the Child Protection Act. 2) In the case of child pornography, the criminal law is used together with the Computer-related Crime Act. 3) In the case of exploitation of children, the main laws to protect are the Child Protection Act and the Computer-related Crime Act. The law is effective, except for posting pictures of children online that law have not yet been actully applied.

          Regarding affirmative measures to strengthen the protection of children's rights other than hard law, the important measures taken by the Center for Child, Women, Family and Human Trafficking including the preventive measures i.e. campaign for knowledge and understanding the protection of children's rights, prevent domestic violence; the investigative measures to extend the arrest of child crimes co-offender/supporter and a person behind the offense; the measures to increase efficiency in the administration of criminal justice, viz. conduct an investigation of children by a multidisciplinary team; and data link measure to have a correct, complete and up-to-date database of cases about children.
