Community Right and Process of Involvement in the Management of Natural Resources and Environment. Case Study of Kham Phai - Non Sa-Ngha, Kalasin Province

Abstract

การศึกษาเรื่องสิทธิชุมชนกับกระบวนการมีส่วนร่วมในการบริหารจัดการ ทรัพยากรธรรมชาติและสิ่งแวดล้อม กรณีศึกษาบ้านคำไผ่-โนนสง่า จังหวัดกาฬสินธุ์ ซึ่งเป็นชุมชนที่สามารถที่ถอดบทเรียนจากกระบวนการหรือขั้นตอนที่ชุมชนได้รับจาก การปฏิบัติตามหลักการสิทธิชุมชนของรัฐและหน่วยงานที่เกี่ยวข้องกับการปฏิบัติ เพื่อให้เกิดผลต่อหลักการสิทธิชุมชน ผลการศึกษาพบว่าจากการที่ประชาชนได้รับ ผลกระทบจากการขุดเจาะก๊าซธรรมชาติในพื้นที่ชุมชนนั้น ประชาชนในชุมชนต่างรู้สึก ถึงความผลกระทบในด้านต่าง ๆ ไม่ว่าจะเป็นด้านสุขภาพ สภาพแวดล้อมและวิถีชีวิต และผลกระทบทางด้านสังคม แต่ประชาชนในชุมชนไม่อาจรู้แน่ชัดได้ว่าผลกระทบที่ เกิดขึ้นนั้นเป็นผลมาจากการขุดเจาะก๊าซธรรมชาติจริง ๆ หรือไม่ เพราะประชาชนไม่ มีความรู้และไม่มีหน่วยงานไหนที่เข้ามาให้ความชัดเจนในเรื่องนี้ แม้จะมีประชาชน บางคนที่รู้ว่าเป็นผลกระทบที่เกิดขึ้นมาจากการขุดเจาะก๊าซธรรมชาติ แต่ก็ไม่รู้ว่าจะ ทำเช่นไรเพื่อที่จะต่อสู้เพื่อที่จะเรียกร้องปกป้องสิทธิชุมชนของตนเอง แม้ว่าจะมีการ รวมตัวกันของประชาชนแต่ก็ยังไม่มีความเข้มแข็งมากพอ ประชาชนบางส่วนไม่กล้าที่ จะออกรวมตัวกันต่อต้าน และมีประชาชนบางส่วนที่มีความคิดเห็นที่แตกต่างกับ ประชาชนที่ได้รับผลกระทบดังนั้นจึงไม่มีการดำเนินการปกป้องสิทธิชุมชนชนของ ตนเองจึงไม่ประสบความสำเร็จCommunity Right and Involvement Process in the Natural Resources and Environmental Management: Case Study of Kham Phai, Non Sa-Ngha, Kalasin Province is a case study of a community having had their community rights affected by a public energy development policy, which led to an instance of how affairs of the government and related organisations can interfere with a community’s rights to manage their own resources and environment. It was found that, being affected by natural gas drilling in the proximity of the community, the people perceived the effects such ashealth, environment, way of life, and social issues, but were unable to substantiate whether those issued were actually caused by the gas drilling, due to limitation of knowledge and understanding in such matter and lack of explanation by public organisation, or some who can accounts the drilling for the effects, but were not aware of any means to defend the community’s rights or their own. Even there were gatherings after the issues arisen, such were not compelling enough to sort out the issues, and for the worse, those who were truly troubled were afraid to gather in order to demand and defend their rights. Furthermore, there were opposing opinions among the affected, causing discord and conflicts in the community. These are just some of the many reasons contributing to why acts of community right protection and conflict management rarely, or never, succeeded.
