บทคัดย่อ
รัฐประหารกับนักกฎหมายดูเหมือนจะเป็นสองสิ่งที่แตกต่างกันโดยสิ้นเชิงและไม่สามารถนำมาเป็นวัตถุในการศึกษาทางกฎหมายเคียงคู่กันได้ เนื่องจากอย่างแรกมุ่งทำลายกฎหมายซึ่งเป็นสิ่งที่นักกฎหมายต้องพิทักษ์รักษาไว้ แต่อย่างไรก็ตามบทความนี้ได้มุ่งศึกษากฎหมายให้ออกไปจากการให้ความสำคัญกับเฉพาะตัวบทกฎหมาย โดยอาศัยตัวนักกฎหมายและการกระทำของ นักกฎหมายมาเป็นวัตถุหลักในการศึกษา ด้วยเหตุนี้ จากการศึกษาบทบาทของนักกฎหมายไทยในช่วงรัฐประหาร 22 พฤษภาคม 2557 ผู้เขียนจึงค้นพบว่านักกฎหมายโดยเฉพาะอย่างยิ่ง นักกฎหมายไทยมีความสัมพันธ์ที่ใกล้ชิดอย่างยิ่งต่อการทำรัฐประหารและไม่ได้จำกัดอยู่เฉพาะบทบาทมือกฎหมายที่ทำหน้าที่สร้างระบบกฎหมายให้กับคณะรัฐประหาร หรือบทบาทของศาลที่ทำหน้าที่รับรองอำนาจของคณะรัฐประหารอันเป็นบทบาทที่เห็นได้ชัดเจนภายหลังรัฐประหารตามที่งานศึกษาหลายชิ้นก่อนหน้านี้ได้ตอบคำถามไว้เท่านั้น แต่นักกฎหมายไทยยังมีบทบาทสำคัญอย่างยิ่งในการใช้และตีความรัฐธรรมนูญจนทำลายกลไกแก้ไขความขัดแย้งทางการเมืองของรัฐธรรมนูญลง และสร้างวิกฤติทางรัฐธรรมนูญขึ้นมาเพื่อเปิดทางให้กับรัฐประหารโดยกองทัพอีกด้วย
