Abstract
At first, it would appear insensible to make coups and lawyers a joint subject of a legal study. The former aims to destroy the law, which is the very thing that lawyers are tasked with protecting. All the same, this article aims to push a study of the law beyond a framework that gives chief importance to the letter of the law. Instead, lawyers and their actions are the primary material of this study. In studying the role of Thai lawyers during the coup of 22 May 2014, the author found that lawyers played a critical role in the success of the coup that was not limited to their role (1) as lawmakers tasked with building a new legal regime for the coup-makers or (2) in courts tasked with supporting the power and actions of the coup-makers. Both these roles were visible in the after the coup, as several previous studies have documented. However, Thai lawyers played another, critical role by interpreting and applying the constitution in ways that destroyed constitutional mechanisms for resolving political conflict. The hollowing of those mechanisms created a constitutional crisis that opened an opportunity for the military to conduct a coup once again.
