บทคัดย่อ
บทความชิ้นนี้พิจารณาประกาศ/คำสั่งของคณะรัฐประหารไทย เรื่องการห้ามมั่วสุมชุมนุมทางการเมืองตั้งแต่ห้าคนขึ้นไป ในฐานะเครื่องมือหนึ่งในการปราบปรามทางการเมืองโดยรัฐ (State Repression) โดยศึกษาพัฒนาการและความเปลี่ยนแปลงของการออกคำสั่งลักษณะนี้หลังการรัฐประหารแต่ละครั้งในประวัติศาสตร์การเมืองไทย ชี้ให้เห็นความต่อเนื่องของการใช้เครื่องมือนี้เพื่อควบคุมอำนาจหลังการรัฐประหาร และการทำให้เสรีภาพในการชุมนุมกลายเป็น “อาชญากรรม” ที่มีความผิดทางอาญา จนกลายเป็นเรื่องปกติหลังการเข้ายึดอำนาจทางการเมืองของกองทัพทุกครั้ง บทความนี้ยังพิจารณาลักษณะของการใช้คำสั่งนี้ในยุคของคณะรักษาความสงบแห่งชาติ (คสช.) ซึ่งมีการบังคับใช้อย่างเข้มข้นที่สุดเมื่อเทียบกับการรัฐประหารทุกครั้งที่ผ่านมา โดยชี้ให้เห็นเป้าหมายของการใช้คำสั่งที่ถูกทำให้กลายเป็น “กฎหมาย” ในการปราบปรามการคัดค้านการรัฐประหาร การควบคุมการชุมนุมแสดงออกต่อการใช้อำนาจหรือการบริหารประเทศของรัฐบาลทหาร การใช้กฎหมายปิดกั้นแทรกแซงกิจกรรมสาธารณะอย่างกว้างขวาง รวมทั้งการใช้กฎหมายสร้างภาระหรือต้นทุนในการออกมาแสดงออกให้กับพลเมืองในสังคม
