บทคัดย่อ
บทความฉบับนี้มุ่งศึกษาแนวคิดพื้นฐานเกี่ยวกับระเบียบว่าด้วยการกลไก Solidarity Mechanism ของฟีฟ่าที่ถูกนำมาใช้ในแวดวงอุตสาหกรรมกีฬาฟุตบอลสากลและวิเคราะห์ข้อพิพาทระหว่างสโมสรกีฬาฟุตบอลเกี่ยวกับค่าตอบแทนที่ให้การฝึกสอน เหตุว่าฟีฟ่ามีหน้าที่รับผิดชอบดำเนินกลไกส่งเสริมสนับสนุนความถูกต้องชอบธรรมและความเป็นธรรมในวงการกีฬาฟุตบอลสากล ในลักษณะที่ส่งเสริมสนับสนุนให้บรรดาสมาชิกทั้งที่เป็นสมาชิกสหพันธ์กีฬาฟุตบอลระดับภูมิภาคหรือสมาชิกที่เป็นสมาคมกีฬาฟุตบอลระดับชาตินำกลไก Solidarity Mechanism ของฟีฟ่าตามหลักเกณฑ์ในมาตรา 21 แห่งระเบียบของฟีฟ่าว่าด้วยสถานะของนักกีฬาฟุตบอลและการโอนย้ายนักกีฬาฟุตบอลข้ามสโมสรมาปรับใช้ ดังนี้สิทธิในโยกย้ายถิ่นฐานของนักกีฬาฟุตบอลจึงอาจเผชิญกับเงื่อนไขบางประการที่เกิดจากการดำเนินกลไกของฟีฟ่าเช่นว่านี้ ขณะที่หลักเกณฑ์ที่ริเริ่มให้มีกิจกรรมเพื่อการบริหารปกครองกีฬาฟุตบอลให้ถูกต้องชอบธรรมได้เปลี่ยนแปลงไปอย่างมากในช่วงทศวรรษที่ผ่านมา ฟีฟ่าในฐานะที่เป็นองค์กรบริหารปกครองกีฬาฟุตบอลสูงสุดก็ได้พยายามพัฒนากฎระเบียบมาตรฐานกิจกรรมกีฬาฟุตบอลในรูปแบบต่างๆ ควบคู่ไปกับขจัดความไม่สมดุลในการแข่งขันกีฬาฟุตบอลระหว่างบรรดาสโมสรกีฬาฟุตบอล เมื่อการส่งเสริมสนับสนุนความถูกต้องชอบธรรมในวงการกีฬาฟุตบอลได้รับการพัฒนาขึ้น การนำเอากลไก Solidarity Mechanism ของฟีฟ่ามาบังคับใช้จึงเป็นความท้าทายประการหนึ่งในการสร้างสมดุลการแข่งขันระหว่างบรรดาสโมสรกีฬาฟุตบอลในด้านการลงทุนทางการเงินเพื่อประโยชน์ทางธุรกิจและ ความถูกต้องชอบธรรมในการโอนย้ายนักกีฬาฟุตบอลข้ามสโมสร
