The Solidarity Mechanism Under the FIFA's Judicial Process.

Abstract

This paper explores the nature of FIFA’s solidarity mechanism regulation in the global football industries and considers the disputes relating to training compensation between clubs. Because the FIFA's responsibility for the functioning of the promotion of integrity and the protection of fair competitions requires their confederations and affiliated associations to enact the solidarity mechanism forming Article 21 of the FIFA Regulations for the Status and Transfer of Players (RSTP), the right to move freely within the FIFA’s global jurisdiction is conditional. While the key principles of FIFA's integrity initiative has undergone dramatic change over the past decade, as the highest governing body of football in the world has striven to improve global football regulatory standards and tackle competitive imbalance between football clubs. As FIFA’s integrity promotion evolves, the applicability of the FIFA solidarity mechanism creates a perennial challenge for competitive balance between club’s financial investment in football businesses and integrity of the transfer system for players.
