บทคัดย่อ
การขัดกันทางอาวุธระหว่างประเทศรัสเซียและประเทศยูเครนที่เกิดขึ้นในปัจจุบันมีการใช้เทคโนโลยีที่ใกล้ชิดกับชีวิตของบุคคลทั่วไปมากขึ้น เช่น การโจมตีทางไซเบอร์พร้อมกับการทำสงครามตามรูปแบบทั่วไป การใช้อากาศยานไร้คนขับในการต่อสู้ และการใช้ระบบ GPS ร่วมกับอาวุธต่อต้านรถถังแบบนำวิถี ส่งผลต่อคำถามในการศึกษาวิจัยในงานนี้คือ การใช้งานเทคโนโลยีที่มีลักษณะการใช้งานร่วมกันระหว่างพลเรือนและทหารส่งผลต่อการปรับใช้กฎหมายมนุษยธรรมระหว่างประเทศอย่างไร และกฎหมายมนุษยธรรมระหว่างประเทศยังสามารถ ปรับใช้ในสถานการณ์ความขัดแย้งระหว่างยูเครนและรัสเซียได้หรือไม่ อย่างไร
ผลการศึกษาพบว่าแม้จะมีความซ้อนทับของพื้นที่การใช้งานเทคโนโลยีที่มีลักษณะ การใช้งานร่วมกันระหว่างพลเรือนและทหารแต่ไม่ได้สร้างผลกระทบอย่างมีนัยสำคัญต่อกฎหมายมนุษยธรรมระหว่างประเทศ กฎหมายมนุษยธรรมระหว่างประเทศยังสามารถใช้บังคับกับสถานการณ์ความขัดแย้งระหว่างยูเครนและรัสเซียได้ แต่การใช้กฎหมายอย่างมีประสิทธิผลนั้น จะต้องมีการบูรณาการนำกฎหมายอื่นที่เกี่ยวข้องกับเทคโนโลยีแต่ละประเภทมาพิจารณาประกอบ โดยไม่ใช้กฎหมายมนุษยธรรมระหว่างประเทศอย่างเป็นเอกเทศแยกออกจากกฎหมายในยามสันติ
