Abstract
Although the Workmen’s Compensation Act B.E. 2537 is the law that is often described as it is created to protect or benefit workers from an accident or illness caused by working for the employer. In fact statistics of the compensation fund show that in the last 10 years in the past, the number of workers who could accessed to the benefits provided by the Workmen’s Compensation Act had steadily declined. The factors that cause this phenomenon are the worker’s decision in 2 ways: first, worker choose not to use legal right, because they are pressured by environmental factors at work. Second, workers can expect the result of case and recognizes the various barriers that they face while using the legal process to claim their rights. Both of factors make workers decide not to use the right that they have, because they think that that decision is worth and more beneficial to them than to claim legal right.
