Abstract
Although, Thai Constitution has constantly guaranteed the right to peaceful assembly of the people. However, the statutory law to which directs the public assembly is just enacted in 2015 by the National Assembly (appointed by the Military Coup).
Even, the objective of this law is to protect the freedom of assembly and maintain public order in the society; but after the law came into force, the fact that there are many people are prosecuted by this law illustrates major problems from this law. The problems from the law on public assembly include unclear definition of ‘public assembly,’ the procedure to inform of the public assembly, enforcement of the government officers, also the court decision concerning the public assembly.
The law on public assembly is one example of the legislation that an attempt to enact the law protecting the right and liberty of people is clear; nonetheless, the result might be totally opposite direction, especially when the country scheme is the authoritarian governing.
