Judicializing Politics: A Case Study of Civil Society's Environmental Movement through Administrative Court 2017-2024

This research investigates the environmental movement strategies employed by Thai civil society through Administrative Court mechanisms from 2017 to 2024. Utilizing a qualitative research methodology based on document analysis of environmental administrative cases initiated by civil society organizations, the findings reveal that Thai civil society has developed systematic and interconnected movement strategies. These comprise four key approaches: issue selection, legal translation of environmental issues, utilization of legal mechanisms in the Administrative Court, and network and alliance building. These strategies reflect the phenomenon of “judicializing politics” in a bottom-up manner driven by civil society and represent a form of legal mobilization that extends beyond merely winning court cases. Instead, it aims to create legal discourse and new political spaces for promoting long-term policy changes. The research findings have significant implications for developing public participation policies in environmental management, improving access to environmental justice mechanisms, and enhancing civil society's capacity to effectively use legal mechanisms to protect community rights and the environment.
