Abstract

Abstract

This research aims to study the legal measures for the management of closed down industrial pollution. Especially the problems and obstacles to the enforcement of legal measures in Thailand. By studying the laws in Thailand compared with international law through the relevant international conventions. This is a qualitative research based on the study of document collection related to pollution from residues from petrochemical plants. The results of the study show that  current legal standard in Thailand are still lacking measures to deal with the pollution problem after the industrial plant closed.  The factory statutes should be amended to cover the closed-down factory and responsibility for pollution after the termination of operation. And set additional criteria for applying for a factory license to have a plan to restore the quality of the environment. The insurance company has the fund to remedy the pollution residue. The duties and powers of the official should be factory and able to inspect the restoration of the environmental quality also covered the closed-down in the application. If the environmental quality is restored, it will be allowed to close. This measure will be effectively reduce the problem of industrial pollution and  the offenders.
