The Evolution of Flood Law in England : Looking Back at the Last 10 Years

Abstract

บทความนี้ชี้ให้ผู้อ่านเห็นว่ากฎหมายน้ำท่วมได้ถูกพัฒนามาเพื่อตอบสนองการจัดการและประเมินความเสี่ยงจากภาวะน้ำท่วมในประเทศอังกฤษ บทความนี้ยังนำเสนอถึงภาพรวมสิบปีแห่งพัฒนาการกฎหมายจัดการความเสี่ยงจากภาวะน้ำท่วม (ค.ศ. 2007-2016) บทวิเคราะห์ของบทความฉบับนี้ครอบคลุมถึงประเด็นสองด้าน ได้แก่ การจัดการความเสี่ยงที่เกี่ยวข้องกับภาวะน้ำท่วมกับการกัดเซาะชายฝั่งและรูปแบบของการประกันภัยที่นำเอากลไกการประกันภัยต่อมาช่วยกระจายความเสี่ยงจนทำให้เกิดระดับอัตราเบี้ยประกันภัยที่ประชาชนพอที่จะจ่ายได้กับช่วยทำให้เกิดจำนวนเงินที่ผู้เอาประกันภัยตกลงจะรับผิดชอบเองกรณีเกิดความเสียหายจากภาวะน้ำท่วมวัตถุประสงค์ของบทความนี้ไม่เพียงแค่นำเสนอภาพรวมของพัฒนาการกฎหมายน้ำท่วมของประเทศอังกฤษ แต่บทความนี้ยังประสงค์ที่จะนำเสนอแนวโน้มในอนาคตที่จะทำให้บรรลุวัตถุประสงค์ของการจัดการความเสี่ยงจากภาวะน้ำท่วมในประเทศอังกฤษThis article presents that flood legislation has been evolved in response to assessment and management of flood risks in England. It also presents an overview on 10 year (2007-2016) of development of the flood risk management regulations. The analysiscovers two aspects of regulatory frameworks: management of risks in connection with flooding and coastal erosion and a form of insurance which is designed to make a reinsurance scheme aimed at ensuring the availability of national insurance at affordable premiums and excesses for flood-related damage. The purpose is not just to provide a picture of evolution of flood law in England, but also to analyse the future trends in order to achieve the aims of providing an approach to managing flood risk across England.
