Reconstruction Bang Rakam Model : The Inequality in Public Duty

Abstract
The Bang Rakam Model 60 Community-Based Water Management Project or The Bang Rakam Water Retarding Field Project was initiated in 2017 on the left bank of Yom river of Bang Rakam district where is an irrigation area. It is the second water management project so-called Bang Rakam Model which the first project was commenced after the flood crisis in 2011 and it had already done on the non-irrigated right bank of Yom river of Bang Rakam district. Besides the differences on time and space, these two water management projects are also different in project’s objectives and procedures. In the areas of the first Bang Rakam Model project, three natural swamps were deepened to be a “monkey cheek” for holding and retarding water. While the Bang Rakam Model 60 project utilizes the rice fields in lowland irrigated areas to be an area of holding and retarding water during August to November. To change the rice fields to water retarding field, the rice farmers must adapt their own period of cultivation to the fixed and recommended calendar of water distribution and rice cultivation of the Royal Irrigation Department. The main objectives of the Bang Rakam Model 60 project aim at reducing the floods from Yom River in Sukhothai city and also an area of lower Chao Phraya basins. During nearly 4 months of water holding, there is still no measure in indemnity toward the affected people in the Bang Rakam Model 60 areas.
The objectives and the procedure of Bang Rakam Model 60 Water Management Project cause the inequality in public duty towards the people living in the area of Bang Rakam model 60. It is the administrative obligation to compensate the people affected by the impact of water management project even though they have the duty to the State. However, this duty must respect the principle of equality. This article aims at showing the inequality in public duty of the people in Bang Rakam Model 60 Water Management Project and also propose the appropriated measures in compensation and recovery.
