ประเด็นท้าทายด้านการคุ้มครองแรงงาน: การคุ้มครองความเป็นมารดา

บทคัดย่อ
องค์การแรงงานระหว่างประเทศได้ออกอนุสัญญาว่าด้วยการคุ้มครองความเป็นมารดา ฉบับที่ 183 ค.ศ. 2000 ส่งผลให้หลายประเทศหันมาให้ความสำคัญกับการคุ้มครองการเป็นมารดามากขึ้น บทความฉบับนี้จึงจัดทำขึ้นเพื่อนำเสนอสาระสำคัญของอนุสัญญาว่าด้วยการคุ้มครองความเป็นมารดา ทฤษฎีการสร้างความผูกพันระหว่างมารดาและบุตร พร้อมทั้งชี้ประเด็นการคุ้มครองความเป็นมารดาในกฎหมายแรงงานของไทย และให้ข้อเสนอแนะต่อการคุ้มครองความเป็นมารดาสำหรับลูกจ้างหญิงในระบบของไทย ผลการศึกษาพบว่า ประเทศไทยมีกฎหมายคุ้มครองแรงงานหญิงระหว่างตั้งครรภ์ หากแต่ยังไม่มีบทบัญญัติสนับสนุนการดูแลบุตรหลังจากแรงงานหญิงสิ้นสุดการลาคลอด ดังนั้นจึงควรมีบทบัญญัติให้แรงงานหญิงมีสิทธิพักในระหว่างเวลาทำงานหรือลดชั่วโมงการทำงานเพื่อให้นมบุตร รวมถึงการออกบทบัญญัติในส่วนของงานที่ห้ามมิให้ลูกจ้างซึ่งเป็นหญิงมีครรภ์ทำงานครอบคลุมไปถึงช่วงระยะเวลาของการเลี้ยงดูบุตรหรือการให้นมบุตรด้วย
