Analysis and Comparison of Exemptions in the Enforcement of Trade Competition Law According to the Trade Competition Act 2017

Abstract

The purpose of this thesis is to study concepts, theories, background, and problems of exceptions to law enforcement. Regarding exceptions to enforcement of trade competition laws According to the Trade Competition Act 2017 compared to foreign countries and recommend appropriate ways to improve the law in order to promote free and fair competition. The results of the research found that (1) Exceptions to the enforcement of trade competition laws in each country applies to the actions of any agency or business unit. It depends on the social context, commercial culture including the economic policy of that country, having provisions of this nature It is so that certain activities can be carried out according to government policy. Prevent being taken advantage of from entrepreneurs who have more competitive ability than other entrepreneurs and also promotes competition which is considered an important mechanism for driving the country's economy as well (2) Exceptions to the enforcement of trade competition laws without appropriate measures, guidelines or supporting criteria, lack of understanding of the intent of the law may cause problems. This can lead to ineffective enforcement of the law. As a result, maintaining and promoting free and fair competition cannot achieve concrete results. (3) Exceptions to competition laws of Thailand and foreign countries. Even though there are differences in details according to the social context, commercial culture, including economic policy but it has the same aim of creating and promoting free and fair competition. Thailand can apply various laws and criteria of each country and adapt appropriately which leads to maximum benefit to the public. (4) Exceptions to Thailand's competition laws must be establish clear and appropriate rules of conduct. From an agency that truly has specialized knowledge and expertise in trade competition. and adjust the law to be consistent with the current reality.
